In terms of the Land Reform Act No 01 of 1972, the lands belonged to persons in excess of the ceiling of 50 acres and the land under the possession of Public Companies as per Act No 35 of 1975 have been alienated to Land Reform Commission.
District Offices have been established in every district where there are lands belonging to Land Reform Commission. Therefore lands can be identified with the assistance of the Field Officers serving attached to such District Offices.
Requests for lands to a project can be made at the time where notifications are published by newspapers, internet and further with the submission of an application to Land Reform Commission.
The maximum of the lands which can be obtained in the name of a person is 05 acres. In case where the extent of the land exceeds 05 acres, the applicant should be a Company registered at the Department of the Registrar of Companies.
A report is called on the instructions of the Chairman or Project Director referring the relevant request to the District Office where the land is situated. Then survey order is issued with the signature of the Chairman for the identification of the total lands belonging to the Commission and released on the approval of you or Executive Director, if the District Director recommends the provision of the relevant land.
First the payment is made by the Land Reform Commission and then the amount is recovered from the applicant of the relevant project. This charge is added in terms of the Circular issued by the Department of Surveyor General.
No. Recommendations are called from the institutions such as Department of Land Use, Central Environmental Authority etc. as to whether the land requested is suitable for the relevant project. Further action in relation to the project can be taken only if the recommendation is received. Then the recommendations made by the Institutions are submitted to the Project Committee and it is submitted to the Commission if the approval is received. If the approval of the Land Reform Commission is received, it should be submitted for the approval of the Minister in charge of the subject for a land up to 05 acres. In case where the extent of the land exceeds 05 acres, it should be submitted with the recommendation of the Minister to the Cabinet of Ministers for the approval.
